Agreement to Terms

By downloading, installing, or using the Double You mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and CHRISTMAS SERVICES SRL ("Company," "we," "us," or "our"), a company registered in Romania.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on mobile devices that you own or control, solely for your personal, non-commercial purposes.

You retain full ownership of all videos, photos, and content you create using the App. We do not claim any ownership rights over your content. All video processing happens entirely on your device - we never access, upload, or store your content.

The App is available for purchase through the Apple App Store and/or Google Play Store. All purchases are processed by Apple or Google, and are subject to their respective terms and conditions.

Refunds: Refund requests are handled by Apple or Google according to their policies. We do not directly process payments or refunds.

Service Availability and Discontinuation: We may suspend, withdraw, or discontinue the App (in whole or in part) at any time, for any reason, and without prior notice.

No In-App Purchases: After purchasing the App, all features are available without additional payment. There are no subscriptions, in-app purchases, or advertisements.

No Obligation for Prorated Refunds or Continued Access: If the App is suspended, removed, or discontinued before the end of any paid period, we are not obligated to provide prorated refunds, credits, or continued access for the remainder of that period, except where required by applicable law or by Apple/Google policies.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles.

Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal negotiation fails, disputes shall be resolved through binding arbitration in accordance with Romanian law.

For EU Consumers: If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights under the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this document.

Your continued use of the App after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

11. Termination

We may terminate or suspend your access to the App, or terminate or discontinue the App itself, immediately and without prior notice, for any reason, including if you breach these Terms.

Upon termination, your license to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Except as required by applicable law, termination, suspension, or discontinuation does not create any obligation for us to provide a refund, credit, or continued access for any unused paid period.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy below, constitute the entire agreement between you and CHRISTMAS SERVICES SRL regarding your use of the App and supersede all prior agreements and understandings.

1. Information We Collect

Crash Reports and Diagnostics (via Sentry)

To improve app stability and fix bugs, we use Sentry, a third-party error monitoring service, to collect anonymous crash reports and diagnostic data when the App encounters an error.

On-Device Processing

All video recording, editing, compositing, and exporting happens entirely on your device. Your creative content never leaves your device unless you explicitly choose to share it through your device's native sharing features.

Crash Data Storage (Sentry)

Crash reports and diagnostic data are sent to and stored by Sentry in the European Union (EU). We have configured Sentry to scrub/block IP addresses and we do not intentionally send personal data or content to Sentry.

Security Measures

We use reasonable administrative, technical, and organizational safeguards to protect the limited information we process. However, no method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

6. Data Retention

We do not store your videos, photos, or edited content on our servers. Your content remains on your device unless you choose to share it.

Crash reports and diagnostic data sent to Sentry are retained for up to 30 days, after which they are deleted or anonymized by Sentry.

7. Children's Privacy

The App is not intended for children under 13 years old (or under 16 in the European Economic Area). We do not target children under 13 and we do not knowingly collect personal information from children. If you believe a child has provided information to us, please contact us and we will delete it.

8. Your Privacy Rights

Because we collect very limited information, some privacy rights may not apply in practice. We will honor applicable requests as required by law.

You may have rights to access, correct, delete, restrict, or object to processing of your personal information, and to data portability. Our company is based in Romania (EU). Crash report data collected via Sentry is processed and stored in the EU. If you access the App from outside the EU, your crash report data may be processed in the EU. Apple and Google may process payment-related data under their own privacy policies.
