10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section HOW CAN YOU CONTACT US ABOUT THIS NOTICE? below.

If you have questions or comments about your privacy rights, you may email us at info@sunset-score.com.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Depending on your state, you may have privacy rights. Because we do not collect or store personal information on our servers, there may be no data for us to provide or delete.

If you want to make a request, you can contact us at info@sunset-score.com. We do not sell or share personal information, and we do not use personal information for targeted advertising.

13. DO OTHER REGIONS HAVE SPECIFIC PRIVACY RIGHTS?

You can contact us at info@sunset-score.com with any privacy questions or requests.

14. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Revised" date at the top of this Privacy Notice. If we make material changes to this Privacy Notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Notice frequently to be informed of how we are protecting your information.

16. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

We do not collect or store personal information on our servers. If you have questions or requests, contact us at info@sunset-score.com.

17. DEVELOPER API AND MCP PRIVACY

In Short: We process forecast inputs and limited technical records to provide and protect the developer API and MCP service. No account or payment details are required.

This section covers requests to api.sunset-score.com/v1/api/forecast and api.sunset-score.com/mcp, including its /mcp/chatgpt endpoint. CHRISTMAS SERVICES SRL, based in Romania, is the controller. Contact us at info@sunset-score.com.

Information and purposes. We process submitted coordinates and requested days to calculate forecasts and determine the location’s timezone. For the ChatGPT-specific endpoint, you may choose a forecast destination by providing coordinates or naming a public place whose approximate center is resolved by the assistant. For near-me requests, the client controls whether approximate location is shared through tool-call metadata; we use its latitude and longitude and ignore other location metadata. Both tools return forecast data without echoing coordinates. We do not ask for a home address or precise device GPS. Near-me forecasts are unavailable without usable client location, but explicitly chosen destination forecasts do not require device location. We use the connection’s IP address to enforce usage limits and prevent abuse, and keep operational records for troubleshooting and abuse protection. Coordinates may relate to a person’s location. We do not use these records for advertising or profiling.

Operational records and retention. Usage counters and request history use a salted network identifier that changes each UTC day. These records are pseudonymous, not anonymous. Request history records UTC request times, REST or MCP access, coordinates rounded to 0.1°, requested days, the detected timezone, response status, processing duration, and forecast score or error summaries. It excludes raw IP addresses, credentials, headers, and full request bodies; access is restricted to the operator. History keeps the current and previous UTC days, with cleanup on writes and at UTC midnight; missed cleanup runs after downtime. Older usage-counter rows are removed on the next admitted request, so they may remain longer while the service is idle.

Other server logs. Routine proxy access logging is not enabled. Service diagnostics include operational errors and startup messages; weather errors can include coordinates and upstream request URLs. System journals are retained according to storage-size and free-space limits, without a fixed age limit. Forwarded system logs rotate weekly, keeping four archives plus the current file. These logs are separate from the short-lived request history and may remain longer.

Service providers and transfers. Hetzner hosts the API/MCP server in Germany. Our weather-data provider is based in Switzerland and receives forecast coordinates, nearby sampling points, requested dates, and our server’s IP address, without the caller’s IP address or network identifier. Its published privacy notice states that API logs may contain coordinates and are deleted after 90 days. Switzerland has an EU adequacy decision. Your AI client or platform handles its own prompts and tool results under its privacy policy.

Plugin audience. The Sunset Score plugin is intended for a general audience aged 13 and older, subject to the host platform's minimum age and required parent or guardian permission. We do not target children under 13. For the plugin, this paragraph replaces the general under-18 wording in Section 9. The limited processing, retention, user rights and contact information in this API/MCP section apply to plugin users. The client controls whether approximate location is shared for near-me forecasts. You may instead choose a forecast destination without sharing device location.

Legal basis and your rights. Where the GDPR applies, we rely on our legitimate interests in providing requested forecasts, maintaining reliability, and preventing misuse. The rights and request procedures in Sections 10, 12, and 15 apply where relevant, including the right to object to processing based on legitimate interests.

TERMS AND CONDITIONS

Last updated February 17, 2026

Plugin-specific clarification added October 11, 2026.

Sunset Score plugin. The free, read-only Sunset Score plugin is available to users aged 13 or older, subject to the minimum age required in their country to use the host platform. Users under 18 must have permission from a parent or legal guardian. This paragraph replaces the adult-only eligibility restriction solely for the plugin. It does not change the terms of mobile purchases or subscriptions. The plugin provides sunrise and sunset beauty forecasts for chosen destinations or client-shared approximate locations; it has no account, payment, subscription or alert functionality.

We are CHRISTMAS SERVICES SRL ("Company," "we," "us," "our").

We provide the Sunset Score mobile app for iOS and Android (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Description of Sunset Score and Its Services

Sunset Score is a mobile app dedicated to helping users anticipate the beauty of upcoming sunrises and sunsets in their chosen location. By entering a city, users can receive a tailored forecast indicating how visually striking the sunrises and sunsets are expected to be in the coming days. Our forecasts are designed for sunrise and sunset enthusiasts, photographers, and anyone interested in planning their day around these natural events.

Product and Features Sunset Score allows users to conveniently search for and access sunrise and sunset forecasts for any city they wish to explore. No account or login is required. The app is designed to be accessible and user-friendly. As our service evolves, we plan to introduce optional client-side notifications, configurable in the app, that alert users when high beauty-score sunrises or sunsets are forecast based on their preferences. These notifications will allow subscribers to stay informed and capture these memorable moments wherever they are.

Disclaimer on Forecast Accuracy While Sunset Score aims to provide the most accurate beauty forecasts possible, the natural variability and complexity of weather and atmospheric conditions mean that these predictions are not guaranteed. We use various environmental factors and models to estimate the beauty of sunrises and sunsets, but we cannot account for every change in weather patterns or local conditions. As a result, users should view these forecasts as guidance rather than guaranteed outcomes.

16. GOVERNING LAW

These Legal Terms are governed by and interpreted following the laws of Romania, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country to residence. 17. DISPUTE RESOLUTION

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least sixty (60) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

Binding Arbitration

Any dispute arising from the relationships between the Parties to these Legal Terms shall be determined by one arbitrator who will be chosen in accordance with the Arbitration and Internal Rules of the European Court of Arbitration being part of the European Centre of Arbitration having its seat in Strasbourg, and which are in force at the time the application for arbitration is filed, and of which adoption of this clause constitutes acceptance. The seat of arbitration shall be Timisoara, Romania. The language of the proceedings shall be English / Romanian. Applicable rules of substantive law shall be the law of Romania.

Restrictions

The Parties agree that any arbitration shall be strictly limited to resolving the Dispute between the Parties on an individual basis only. To the fullest extent permitted by applicable law, (a) no arbitration or other legal proceeding shall be joined or consolidated with any other, and no Dispute may be arbitrated or litigated on a class, collective, or representative action basis; (b) there is no right or authority for any Dispute to be arbitrated or resolved on a class-action basis or to utilize class-action procedures; and (c) there is no right or authority for any Dispute to be brought or litigated in a purported representative capacity on behalf of the general public or any other persons.

Exceptions to Informal Negotiations and Arbitration

The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
